Durante el día de hoy el fiscal federal Diego Luciani apeló de la causa Vialidad, en la cual se condenó a la vicepresidente Cristina Kirchner a 6 años de prisión por defraudación al Estado, con inhabilitación perpetua para ejercer cargos públicos y solicitó que también sea condenada por asociación ilícita.
De acuerdo a la información que pudo acceder la señal de TN por medio de fuentes judiciales, Luciani realizó una presentación, en la cual pidió que Cristina Kirchner sea condena por asociación ilícita, así como también Lázaro Báez, José López y Nelson Periotti, y que además se revocaran las absoluciones de Julio De Vido, Abel Fatala y Héctor Garro.
Según explicó: “La contundente sentencia del Tribunal mostró de manera palmaria el acto de corrupción más grave de la historia de nuestro país desde el advenimiento de la democracia”.

Por otro lado, indicó: “Las gravísimas circunstancias fácticas comprobadas por el Tribunal se ajustan, sin mayores esfuerzos, a las exigencias del tipo penal de asociación ilícita. Para que se entienda bien, se trataba de un ´traje a medida´ y la mayoría del Tribunal convirtió esta figura en un ´traje estrecho´ o, peor aún, en un tipo penal prácticamente inaplicable para casos de corrupción en la Administración pública”.
En la causa se analizaron las 52 obras públicas viales que las empresas de Báez recibieron para Santa Cruz durante los gobiernos de Néstor y Cristina Kirchner. El tribunal entonces entendió que hubo corrupción, pero tuvieron una diferencia, donde los jueces Rodrigo Giménez Uriburu y Jorge Gorini analizaron que en el caso no se dio el delito de asociación ilícita, mientras que Andrés Basso entendió que si lo hubo.
En cambio, desde la defensa exigieron la absolución de la vicepresidenta al argumentar que el fallo en su contra contiene “arbitrariedad fáctica y normativa” y constituye “un supuesto de enorme gravedad institucional”.
