Cristina Kirchner: «Cuando Luciani dice que si aprieta sale pus, es de ustedes, los macristas»
Después del pedido de 12 años de prisión e inhabilitación perpetua para ejercer cargos públicos que hizo ayer el fiscal del juicio de la Obra Pública Diego Luciani, la vicepresidenta Cristina Kirchner respondió las acusaciones en su contra en un transmisión titulada «Derecho de defensa«.
Es que los jueces del Tribunal Oral en lo Criminal Federal N°2 rechazaron ayer el pedido que presentó por medio de su abogado Carlos Beraldi para ampliar su indagatoria. De esa manera, usará su cuenta de YouTube para responder los principales puntos de la acusación de Luciani, quien concluyó en su etapa de alegatos que la vice y actual titular del Senado fue la jefa de una asociación ilícita destinada a favorecer con contratos de obras públicas al empresario Lázaro Báez.
Entre las pruebas que presentó, se valió de un total de 9.000 páginas de mensajes del ex secretario de Obras Públicas, José López, donde se constataba su relación con el empresario Nicolás «Nicky» Caputo. Además, dijo que el juicio es «contra el peronismo» y cuestionó los criterios de Luciani y Sergio Mola. Esas mismas páginas fueron presentadas como prueba por parte de los fiscales.
La Vicepresidenta comenzó hablando de su derecho a la defensa “de la misma manera que los fiscales pudieron leer su guion durante nueve jornadas”.
“La sentencia ya está escrita, como dije en alguna oportunidad”, cuestionó Cristina Kirchner a los fiscales y jueces que la juzgan en la causa Vialidad.
“La primera resolución de Javier Iguacel en Vialidad es ordenar una auditoria en Santa Cruz, y presenta la denuncia ante Ercolini y (el fiscal Gerardo) Pollicita”, alegó. Al comenzar su alocución, había manifestado que el juez Julián Ercolini se había declarado incompetente en una denuncia anterior por corrupción de la obra pública.
Recogiendo distintas tapas de medios, agregó: «Nadie sabe de donde salen las cifras que dicen«, en referencia a los montos de la supuesta corrupción que se juzga. En el noveno alegato, Luciani aseguró que el desfalco contra el estado fue de más de 5 mil millones de dólares.
Luego citó una declaración del interventor de Vialidad en Santa Cruz, Leandro Martín García, durante la gestión macrista. “No encontré ninguna situación anómala”, citó CFK sobre las palabras del ex funcionario. “Con Iguacel le quitaron las obras a Austral Construcciones y quedaron paradas”, agregó.
Citas a Rodríguez Simón y la «Gestapo macrista»
Luego comenzó a mencionar el funcionamiento de un dispositivo judicial creado «desde Casa Rosada» por el ex presidente Mauricio Macri. “Fabián Rodríguez Simón amenazó a la procuradora Alejandra Gils Carbó para que renuncie”, aseguró sobre el prófugo conocido como «Pepín». Posteriormente mostró una fotografía del ex integrante del Parlasur con Elisa Carrió y la diputada Mariana Zuvic.
También habló sobre la denominada «Gestapo macrista», luego de que se filtrara un video del ex ministro de Trabajo de María Eugenia Vidal; Marcelo Villegas, hablando de crear un grupo para apresar a dirigentes gremiales.
La relación de José López con Nicolás Caputo
«Mi sorpresa es que el supuesto socio mío, Lázaro Báez, tiene sólo tres mensajes con López. Y también con que Nicolás Caputo, hermano de la vida de Macri, tenía mensajes con López y José Fredes Amilcar«, mostró CFK en una serie de archivos. Las pruebas fueron sacadas de 9 mil páginas de mensajes del ex funcionario de Obras Públicas y su Jefe de Gabinete.
En esos mensajes se habla de suspender un pago a la empresa brasileña Odebrecht, juzgada y condenada por distintos grados de corrupción con el estado.
También se refirió al soterramiento del ferrocarril Sarmiento y un decreto en una ampliación de presupuesto firmado en 2016 por la vicepresidenta Gabriela Michetti. «45.000 millones de pesos fue para una obra que había sido licitada con la condición de que sea financiada por empresas. El estado cambia las reglas y perjudica al erario público«, expresó la titular del Senado.
De acuerdo a su testimonio, la empresa IECSA que fue propiedad de la familia Macri fue la beneficiaria de ese monto. Cuando asumió en la Casa Rosada, el ex presidente de Boca afirmó que había vendido sus acciones para no generar conflicto de intereses.
«Luciani dice que estuvo meses revisando los chats, ¿no vio esto?«, dijo sobre los diálogos entre López y Caputo, subrayando su nivel de familiaridad en el trato. «¿Cuáles son los criterios de Luciani y Mola?», se preguntó ante la serie de mensajes que muestran la relación entre López y Caputo.
El último registro de una charla entre ambos fue cuando se disputaba la PASO donde triunfaría Mauricio Macri, en agosto del 2015.
«La Comisión de Viales de la Cámara Argentina de la Construcción se reunía con López para ver presupuestos de las obras y los fiscales no lo vieron», agregó la presidenta del Senado. «¿Qué hicieron los fiscales con esas llamadas?», se preguntó.
«Cuando Luciani dice que si aprieta sale pus, es de ustedes, los macristas«, cuestionó citando una frase del fiscal.
«No hay partidos militares pero si judicial, que es para desplazar a los gobiernos populares. Pero acá hay un paso más: protegen a los que verdaderamente roban en el país», se envalentonó.
Además, aseveró: «Se comprueba que Mauricio Macri siguió a los familiares del ARA San Juan y lo sobresee el arquero del Liverpool, el equipo de Los Abrojos. A ellos los protegen«.
«Si naciera 20 veces, 20 veces haría lo mismo. Este Tribunal no es de la Constitución. El papá del presidente del Tribunal (Rodrigo Giménez Uriburu) postea contra mí en el espacio de Liverpool, y fue funcionario de Galtieri», agregó. «Es un juicio al peronismo«, aseguró.
«Se sostiene que los tres gobiernos kirchneristas yo era la jefa de la banda. Van por todo», cerró en su exposición.
Cristina Kirchner se dirige al Congreso
Entre cánticos y acompañada por su seguridad personal, Cristina Kirchner se subió a un Toyota Corolla color negro y se dirigió al Congreso, desde donde ofrecerá a partir de las 11 su defensa contra las acusaciones de los fiscales Diego Luciani y Sergio Mola.
Vestida de colores claros y sonriente, a las 10.35 saludo a los militantes y levantó los dedos en V, escoltada por dos hombres. Segundos antes de subir al vehículo, miró a ambos lados y levantó las manos, golpeandosé el corazón en señal de agradecimiento.
Seguidores de Cristina Kirchner se concentran afuera de su casa antes de la defensa
Luego de las manifestaciones a favor y en contra que se vivieron en la noche del lunes en la puerta del domicilio de la Vicepresidenta, desde temprano distintos manifestantes se apostaron en la calle a la espera de su salida hacia el Congreso, desde donde transmitirá su defensa por el juicio.
Hay una fuerte expectativa por lo que pueda llegar a decir la funcionaria tras las nueve audiencias en las que Luciani expuso los motivos por los cuales la consideró parte clave del entramado de corrupción.
Su abogado Carlos Beraldi adelantó en la noche del lunes por dónde puede ir parte de la defensa. “Lo que quiere (Cristina Kirchner) es mostrar con claridad que estas supuestas nuevas pruebas y estos hechos que aparecen ahora como novedosos son absolutamente falsos, y va a mostrar una serie de elementos que indiquen, y la gente pueda ver, la manera sesgada en la que se analizó ese teléfono de (José) López, donde hay muchos empresarios”, dijo.
Vale referir que los representantes del Ministerio Público vienen de exponer una serie de pruebas tales como mensajes de texto entre funcionarios donde aparece mencionada como «la jefa», «sra.» o «pta», algo que para Luciani la ubica al tanto de las presuntas maniobras delictivas.
A su vez, los fiscales presentaron un esquema a partir de las pruebas recopiladas donde aparece, junto a Néstor Kirchner, en la cúspide de una pirámide. Por debajo figuran el ex ministro de Obras Públicas, Julio De Vido, y su secretario José López. Este, a su vez, con estrecho contacto con Báez durante el desarrollo de las 51 obras que están bajo la mira.
De acuerdo con el relato del fiscal, la organización supuestamente liderada por la actual vicepresidenta se extendió desde pocos días antes del 10 de diciembre de 2003 con el nacimiento de Austral Construcciones hasta el 9 de diciembre de 2015. Con la llegada de Mauricio Macri al poder, Luciani y Mola describieron que se puso en marcha el operativo «limpiar todo».
Así denominaron una serie de mensajes de la etapa final del periodo investigado, donde el 28 de noviembre de 2015 hubo un mensaje de López en el que habló de «limpiar todo».
«Esto es hasta el 15 de enero», le dijo ex el secretario a Julio Mendoza, directivo de Austral Construcciones, a lo que éste respondió que no entendía lo que decía. “Limpiar todo. Ok. No dejar sensación nunca más retomar las obras”, aclaró López.
Ante esto, Mendoza respondió: «El lunes o martes limpiamos a todos». López contestó: «Solo que no hay que dar sensación de fuga. Mendoza: «Ahora es final. Neutralización, despido, pago, después acomodamos lo que quieran».
La reacción de Cristina Kirchner
Este lunes, día clave en el juicio porque concluyeron los alegatos, Cristina reaccionó. Fue antes de que se conociera el pedido de condena del fiscal cuando anunció que pediría la ampliación de su indagatoria.
«Ante la falta de pruebas en el juicio oral y las declaraciones de los testigos que demolieron la denuncia de Iguacel; los fiscales, en abierta violación del principio de defensa en juicio, montaron en su acusación cuestiones que nunca habían sido planteadas«, escribió en Twitter.
Más tarde, cuando terminó la audiencia y se supo del rechazo de los miembros del Tribunal a su pedido de declarar volvió a despacharse.
En esa ocasión escribió que «si algo faltaba para confirmar que no estoy ante un tribunal de la Constitución, sino ante un pelotón de fusilamiento mediático-judicial, es impedirme el ejercicio del derecho de defensa ante cuestiones que nunca figuraron en el acto de acusación del fiscal al que asistí durante 5 días en mayo de 2019″
Ahí fue cuando anunció que hoy a las 11 va a «demostrar, justamente, por qué me están prohibiendo hablar en el juicio después del obsceno guión que montaron los fiscales«.
