Juicio a Cristina Kirchner: para la Fiscalía, el perjuicio al Estado nacional fue de 5.231 millones de pesos
El fiscal federal Sergio Mola dijo hoy que el fraude contra el estado en las obras públicas que recibió el empresario Lázaro Báez fue de 5.321 millones de pesos, que equivalen a 926 millones de dólares. Así lo expuso en un tramo de la novena y última audiencia de alegatos de la Fiscalía en la que harán el pedido de condena para la vicepresidenta de la Nación, Cristina Kichner, y el resto de los 12 acusados.
Mola terminó de analizar la parte económica de las irregularidades de las 51 obras que recibieron las empresas de Báez y concluyó que el fraude al estado fue de 5.321.049.272,47 de pesos. Para eso se apoyó en una planilla donde describió cada una de las obras y el monto del perjuicio.
En esta última audiencia Cristina Kichner no estuvo presente ya que fue autorizada por el Tribunal Oral Federal 2 a no estar en la etapa de alegatos por sus funciones institucionales como vicepresidente.
Mola inició el alegato con el análisis de la situación de los ex funcionarios del Ministerio de Planificación y de Vialidad de la provincia de Santa Cruz respecto del delito de administración fraudulenta. Relató como a criterio de la Fiscalía los ex funcionarios incumplieron sus funciones en los controles al empresario Báez.
“A esta altura no es creíble que Abel Fatala no tuviera conocimiento, como no es creíble que Cristina Kirchner no se enterara de nada”, dijo Mola sobre quien era funcionario de Planificación.
Al final de la jornada está previsto que los fiscales hagan el pedido de pena para todos los acusados. El fiscal Luciani acusó el viernes pasado a la vicepresidente de ser la jefa de una asociación ilícita. “Ha quedado demostrado que la persona que se revela como jefe de la asociación ilícita es Cristina Fernández”, sostuvo Luciani. La Fiscalía también dijo que formaron parte de la asociación ilícita el ex ministro de Planificación Federal Julio De Vido, el ex secretario de Obras Públicas José López, el ex titular de la Dirección de Vialidad Nacional Nelson Periotti y Báez. “Está acreditado el acuerdo de voluntades de la asociación que operó de manera permanente y que cada uno realizó con dolo los aportes necesarios”, sostuvo.
La expectativa para hoy estará en cuántos años de prisión la Fiscalía pedirá para Cristina Kirchner. Puede ir de los 7 a los 16 años de prisión, sumando los mínimos y los máximos de los delitos de asociación ilícita y fraude en perjuicio de la administración pública. En lo que no hay duda es que solicitará que la vicepresidenta no puede ejercer más cargos públicos porque esa pena está prevista para el fraude en perjuicio de la administración pública.
“Al asumir Néstor Kirchner la Presidencia de la Nación y luego su esposa, Cristina Fernández, instalaron y mantuvieron en el seno de la administración nacional y provincial de Santa Cruz una de las matrices de corrupción más extraordinarias que lamentablemente y tristemente se hayan desarrollado en el país”, dijo Luciani en su primera audiencia, el 1 de agosto.

Los acusados en el juicio son 12: Cristina Kirchner, Báez, De Vido, Fatala, López, Periotti, Carlos Kirchner, ex titular de la Subsecretaría de Coordinación de Obra Pública Federal y primo del ex presidente Néstor Kirchner; Nelson Periotti, ex titular de la Dirección Nacional de Vialidad; Raúl Daruich y Mauricio Collareda, ex jefes del distrito Santa Cruz de la Dirección Nacional de Vialidad; y Héctor Garro, Juan Carlos Villafañe, Raúl Pavesi y José Santibañez, todos ex presidentes de la Administración General de Vialidad de Santa Cruz. La Fiscalía desvinculó a Carlos Kirchner del delito de asociación ilícita porque sostuvo que no se demostró su participación.
Cuando finalicen los alegatos de la Fiscalía será el turno de las defensas. Cada una de las 13 tendrá tres audiencias para exponer su postura. La primera será la de Báez y la de Cristina Kirchner la sexta. La expectativa del Tribunal es dar a conocer su veredicto antes de fin de año.
En la audiencia de hoy se sumó un anuncio sorpresivo de Cristina Kirchner. Por su cuenta de la red social Twitter anunció que quiere declarar mañana. “He instruído a mi abogado para que, a los efectos de poder ejercer efectivamente mi derecho a defensa en juicio, solicite la ampliación de mi declaración indagatoria para la audiencia del día de mañana, 23 de agosto”, tuiteó.
