Lo que parecía ser una muerte natural, con el correr de las horas y el resultado de la autopsia médico legal ordenada por el Magistrado Marcelo Cardozo, se confirmó que Luis Alberto Benítez (38) tuvo una muerte violenta por traumatismo de cráneo.
Tomaron intervención en el hecho efectivos policiales de la Comisaría Décimo Quinta, quienes arribaron al lugar tras ser requeridos en una vivienda ubicada en el barrio Aeroclub de Posadas.
Una vez en el lugar, se entrevistaron con la hermana de la víctima, quien manifestó que en un momento dado, ingresó a la habitación de Benítez y se encontró con el hombre acostado en la cama sin signos vitales.
Por orden el Juzgado de Instrucción Uno de Posadas, a cargo de la investigación, el cuerpo del hombre de 38 años fue trasladado a la Morgue Judicial para la autopsia.
Al conocerse los resultados, la causa dio un giro de 180 grados ya que, se determinó que Benítez había tenido una muerte violenta por traumatismo de cráneo, como consecuencia de un fuerte golpe en la nuca.
Conforme a trabajos realizados en conjunto con el personal de la Dirección de Homicidios, BBII URX y efectivos de la Comisaría Décimo Quinta, mediante trabajo de campo se logró establecer preliminarmente que podría estar relacionado como presunto autor material del presente hecho el cuñado de la víctima.
El hombre fue identificado como Pedro Walter E. (46), quien a su vez es propietario de la vivienda donde residía Benítez. Según las primeras averiguaciones, el hecho ocurrido se habría originado en circunstancias que Benítez, paciente psiquiátrico-esquizofrénico, presentaba una conducta violenta.
