El Gobierno modificó este jueves algunos requisitos para acceder a la jubilación anticipada por desempleo, vigente desde el año pasado.
El beneficio alcanza a quienes tienen 30 años o más de aportes al sistema previsional, les falte hasta 5 años para jubilarse y estaban desempleados al 30 de junio de 2021.
La Resolución 2/2022, publicada en el Boletín Oficial, permite a la Secretaría de Seguridad Social “computar ciertos períodos en los que no se han prestado servicios o durante los cuales no existía obligación legal de ingresar cotizaciones con destino a la seguridad social, tales como el período de licencia legal por maternidad y el período durante el cual se ha percibido prestaciones por desempleo”.
También se permitirá computar como años de servicio los períodos amparados en esquemas de regularización de deudas previsionales «cuyas deudas hayan sido canceladas con anterioridad al 30 de junio de 2021», según el texto oficial.
Para el Poder Ejecutivo, «resulta de estricta justicia permitir computar» el período de licencia por maternidad «en atención a que la carrera laboral de las mujeres se ve obligatoriamente interrumpida a causa de la gestación por el período que fijan las normas respectivas, no pudiendo ello redundar en un menoscabo de sus derechos».
Además, resaltó que en las últimas décadas «reiterados ciclos de contracción de su mercado de trabajo, cursando períodos de alta desocupación e informalidad laboral, situación que derivara en serias dificultades económicas para que las personas pudieran tener continuidad en sus trayectorias contributivas a la seguridad social».
Características de la jubilación anticipada por desempleo
La Prestación por Desempleo «es una prestación contributiva de la seguridad social y el tiempo de su percepción se computa como tiempo efectivo de servicio a los fines previsionales del régimen general».
La jubilación anticipada equivale al 80% del haber calculado a la fecha de solicitud, pero en ningún caso puede resultar inferior al haber mínimo, que desde la semana que viene aumenta a $32.630. Los beneficiarios tienen derecho a los servicios que otorga el PAMI y a las asignaciones familiares.
La prestación tiene como objetivo «paliar la situación de desempleo y falta de ingresos de un gran sector de la población nacional con edades avanzadas, que pese a acreditar los años de servicios requeridos para obtener una jubilación ordinaria no puede acceder a ésta por no tener cumplida la edad necesaria», según el Gobierno.
Este tipo de jubilación dejará de ser percibida cuando se alcance la edad jubilatoria (60 años las mujeres y 65 los varones) y los beneficiarios pasen a cobrar el 100% del haber previsional que les corresponda.
