Crimen de Lucio Dupuy: la mamá del niño y su pareja fueron declaradas culpables de homicidio agravado
La pareja y la madre de Lucio Dupuy, el niño asesinado en La Pampa
(Noticia en desarrollo) El juicio por el crimen de Lucio Dupuy llegó a su fin. Los jueces Alejandra Ongaro, Andrés Olié y Daniel Sáez encontraron culpables a la madre del nene, Magdalena Espósito Valenti, y a la novia de ella, Abigaíl Páez, de los delitos de homicidio agravado. Para la Justicia ya no hay dudas, son las asesinas del chiquito.
Páez fue condenada además por abuso sexual agravado.
Espósito Valenti, que también había sido acusada de abuso sexual, fue absuelta de este delito, lo que generó sorpresa en la querella.
La progenitora de Lucio fue condenada por homicidio con tres agravantes: alevosía, ensañiamiento y vinculo. En cambio, su novia, por los de alevosia y ensañamiento. Los magistrados entendieron que no había vinculo en su casa, en terminos jurídicos.
El veredicto fue leído algunos minutos después de las 12, sin la presencia de las acusadas, que decidieron seguir la lectura del fallo desde la cárcel en la que están alojadas en San Luis. Apenas escucharon la sentencia, se pararon y se fueron de la sala donde estaban ubicadas.
En la puerta de tribunales se produjo una gran manifestación que celebró el fallo luego de ser pronunciado dentro de la sala. En el lugar estaba Cristian Dupuy, el papá de Lucio, sus tíos y también sus abuelos paternos, Ramón y Silvia.
Si bien los fundamentos del fallo se conocerán en breve, hay algunas pruebas fundamentales que fueron las que le permitieron a los magistrados tomar la decisión de condenar a las acusadas. La autopsia, los chats entre ellas y la palabra de los testigos.
El abogado de la familia, José Mario Aguerrido, habló a la salida del tribunal y se mostró disconforme con que la amdre no haya sido condenada pro el abuso: “Estamos relativamente conformes, queremos ver los fundamentos. Nos sorprendió la absolución de la madre con respecto al delito de abuso sexual. Quiero leerlo bien y analizaremos si lo apelamos”.
Además, agregó mirando al cielo y entre lagrimas: “Lucio ya puede descansar en paz, lo más importante era la responsabilidad por homicidio agravado, lo que indica que recibirán prisión perpetua”. Luego, añadió: “Estoy muy emocionado, conviví dos años con el horror”

La autopsia
La más importante, quizás, de las pruebas presentadas en el juicio fue la autopsia. Estuvo expuesta por Juan Carlos Toulouse, el médico que realizó el estudio del cuerpo de Lucio, en la cuarta audiencia del debate oral.
Ante los magistrados, Toulouse reafirmó que el niño falleció a causa de una “feroz golpiza” y que presentaba “lesiones en varias partes del cuerpo”, según informaron fuentes judiciales.
Aseguró que había sido víctima de abusos sexuales “recientes y de vieja data”, al mismo tiempo que presentaba “un fuerte golpe que le afectaba la cadera, el glúteo y la pierna, con una data de 7 a 8 días”.
“Hubo una agresión puntual que le provocó la muerte”, según la autopsia presentada en la causa. Lucio murió a raíz de una hemorragia interna provocada por una paliza. Además de los signos de abuso, presentó quemaduras y mordidas.
El documento forense también evidenció que, al igual que Fernando Baéz Sosa, Lucio tenía la suela de una zapatilla marcada en la espalda. Gracias a una pericia scopométrica, se determinó que el calzado le pertenecía a Abigaíl Páez, la novia de la madre.
“Abigail Páez lo pisó con tanta fuerza en su espaldita que, probablemente, le reventó el corazón junto a distintos órganos”, revelaron los médicos que hablaron en el juicio.

Los chats entre las acusadas
Tal como reveló Infobae, las conversaciones que tuvieron las imputadas, entre ellas, a través de WhatsApp los meses previos al asesinato se convirtieron en una prueba esencial. Básicamente porque allí relataban los castigos que le propinaban al nene.
“Qué no se te vaya la mano que nos vamos a mandar una cagada”, fue uno de los mensajes que le mando la mamá de Lucio a su novia cuando faltaban pocos días para el homicidio. “Estoy harta. Yo tengo que estar todo el día con este pendejo”, era una respuesta habitual en Abigaíl Páez.
Ante un episodio, de octubre del 2021, en el que Lucio vomitó, las imputadas hablaron entre ellas del castigo que se le aplicó al nene. “¿Cómo le pegaste? Ya van dos veces que vomita”. Luego de eso La novia de la madre escribió: “No lo quiero ni ver a Lucio porque me amarga la vida”.

Los testimonios en el juicio
Si bien fueron más de cien los testigos que pasaron por la sala de audiencias, entre ellos el papá y los abuelos de Lucio, existieron algunos relatos que llamaron mucho la atención porque desnudaron, aún más, el horror al que estuvo sometido el nene.
Por un lado, una vecina contó que escuchaba los golpes, que llamó a la policía y nadie hizo nada y que, un día, oyó a las acusadas decirse entre ellas: “sacale la ropa y cagalo a palos, dejalo marcado porque lo mato yo”.
Por el otro, las madres de los amiguitos de Lucio contaron cómo quedaban asombradas, cada vez que la víctima era invitada a almorzar, por la cantidad de comida que ingería. “Eso se daba porque Lucio pasaba hambre. Además de todo lo que le hacían, no le daban alimento”, señaló el abogado de los Dupuy, José Mario Aguerrido.
Claro está que en el expediente, y en el juicio que terminó hoy, hay más evidencias. Algunas espeluznantes como las lesiones compatibles con abuso sexual y el ADN de Lucio en el juguete sexual de la madre y su novia. Todo este cúmulo de pruebas llevaron a los jueces a tomar su decisión final.
