BRASIL | Una jueza negó el derecho al aborto a una niña que fue violada y la envió a un hogar
Una jueza brasileña le negó el derecho al aborto legal a una niña de 11 años que quedó embarazada luego de haber sido violada y la envió a un instituto de menores, retirándola de su casa familiar para evitar la interrupción del embarazo, luego de intentar manipularla en un interrogatorio con preguntas sobre si ya había pensado el nombre del bebé.
La jueza Joana Zimmer intentó junto con la fiscalía de menores convencer a la niña de que desistiera de la interrupción del embarazo con esas conductas manipuladoras, según el video de la audiencia revelado por el sitio The Intercept Brasil.
«¿Podrías esperar dos o tres semanas más para que ese bebé pueda ser entregado a una pareja en adopción? ¿No tenés expectativa de quedarte con el bebé?», son algunas de las preguntas hechas por la jueza Zimmer.
El caso, que ocurrió en el estado de Santa Catarina, sur de Brasil, fronterizo con la provincia de Misiones, llevó a la Corregiduría (Asuntos Internos del Poder Judicial) a abrir una investigación sobre el comportamiento de la magistrada.
En Brasil el aborto es legalizado por riesgo de vida hacia la madre y por violación, pero el procedimiento fue negado a las 22 semanas de gestación por parte de los médicos del Hospital Universitario de Santa Catarina, en Florianópolis, que argumentaron que necesitaban una orden judicial.
El caso se inscribe en las recomendaciones lanzadas desde el Ministerio de Derechos Humanos, Familia y Mujer que condujo hasta mayo la pastora evangelista Damares Alves, candidata a senadora y la líder más importante del país en criminalizar los casos de aborto permitidos por el Código Penal.
El caso ocurrió en Tijucas, un municipio ubicado entre Florianópolis, capital de Santa Catarina, y el Balneario Camboriú.
La jueza escribió en su fallo que la madre de la niña violada quería realizarle el aborto.
«En lugar de proteger a su hija, la quería someter a un homicidio», afirmó la jueza, que indicó que el aborto solamente sería posible con 22 semanas de gestación, cuando actualmente transcurre la semana 29, de acuerdo con la cadena Globo.
Entonces, Zimmer retiró de la casa familiar a la niña y la internó en un hogar de menores.
«Si ella se quedaba con la madre, el aborto iba a ser realizado sin tener en cuenta la vida del bebé», afirmó la juez en su fallo.
La fiscal del caso, Mirela Dutra, fue la que le pidió a la jueza internar a la niña y reconoció que no tiene estructura biológica apta para un embarazo.
La fiscal, en el interrogatorio a la víctima el 9 de mayo, le dijo a la víctima que lo recomendable es seguir con el embarazo.
«En lugar de dejarlo morir -porque el ya es un bebé, un niño- en lugar de sacarlo de tu vientre para verlo morir, porque Brasil no está de acuerdo con la eutanasia, él va a nacer llorando, no le vamos a dar un remedio para que se muera», dijo la fiscal en la audiencia.
«Tu bebé está completo, ya es un ser humano», le dice la fiscal Dutra a la niña en el video de la audiencia, además de proponerle «esperar dos o tres semanas más» para que pueda nacer sano y entregarlo en adopción.
La audiencia está grabada y el video fue divulgado por The Intercept Brasil, el mismo portal de noticias que reveló el escándalo de manipulación de causas en la Operación anticorrupción Lava Jato.
Entonces, según el video, la conversación retoma la idea de que el embarazo debe continuar para que el niño pueda ser entregado en adopción.
La siguiente es la conversación que se aprecia en el video de la audiencia entre la jueza y la niña víctima de violación.
– ¿Cuál es la expectativa que tenés respecto del bebé? ¿Quéres que nazca?, pregunta la juez
– No, respondió la niña.
En el video aparece un crucifijo en la sede del Poder Judicial.
– ¿Te gusta estudiar?
– Sí.
– ¿Creés que tus estudios estarán afectados en tu condición?
– Sí.
Como se acercaba el cumpleaños de la niña, la jueza aprovechó para inducirla a hablar del bebé y no del aborto.
– ¿Tenés algún pedido especial para tu cumpleaños? Podés hablar sin problemas. ¿Querés elegir el nombre del bebé?
– No, respondió la niña, de nuevo.
En la audiencia, la jueza llama al violador como «padre del bebé».
-¿Creés que el padre del bebé estaría de acuerdo en entregarlo para adopción?
– No sé, responde la niña.
La audiencia con la madre de la víctima apunta a la salud del bebé y no de la víctima.
La jueza le dice en la audiencia de 14 minutos a la madre de la víctima que «hay tecnología actualmente para salvar al bebé» porque «tenemos 30.000 parejas que quieren el bebé y aceptan el bebé, la tristeza de usted y de su hija será la felicidad de una pareja».
La madre le responde, llorando, a la jueza: «Es una felicidad para ellos, porque no están pasando lo que estoy pasando»
«Ustedes le hacen estas preguntas a ella que ni sabe ni responder sobre lo que pasa. La crié yo sola, con ayuda de mis padres», aseguró.
El 12 de mayo, ante el pedido de la familia, un juez del tribunal de segunda instancia determinó el aborto legal a raíz de que los médicos del caso habían advertido sobre los riesgos para la vida de la víctima.
Pero al día siguiente la fiscalía apeló ese fallo diciendo que la niña ya estaba en manos de la justicia de menores y en instituto para resguardar su vida.
Una cámara de apelaciones también rechazó el caso, con lo cual la víctima fue sacada de su casa familiar y está en soledad esperando terminar con la gestación.
La Orden de Abogados de Brasil, principal organismo de derechos humanos del país, anunció que interviene en el caso buscando la protección integral de la víctima de violación, que tiene derecho a un aborto legal.
Una de las expertas del derecho de las mujeres en Brasil, la exjueza Maria Berenice Dias, vicepresidente del Instituto Brasileño de Familia, calificó la audiencia con la víctima como «una aberración nunca vista en 50 años de carrera».
«El laudo médico indica que estaban listos para interrumpir el embarazo pero la jueza y la fiscal resolvieron que no. La jueza decidió que era mejor que el bebé naciera para darlo en adopción, intentando convencer a la niña con lenguaje perverso, como ‘hijito, ‘bebito’, preguntando si quería elegir el nombre», afirmó la especialista Dias.
