La demanda por enriquecimiento ilícito que preocupa a Alberto Fernández
El ex diputado de la Nación por la Ciudad de Buenos Aires en representación de Cambiemos, Jorge Enríquez, denunció al presidente Alberto Fernández por la comisión de delito de enriquecimiento ilícito, que se encuentra previsto y reprimido por el artículo 268 del Código Penal. Enríquez, quien dejó su banca en diciembre del 2021, interpuso la acción legal con el patrocinio de los abogados Eric Natansohn y Luis Cevasco.
La medida se enmarca en las acciones legales que Alberto Fernández inició contra la presidente del Pro, Patricia Bullrich, a través de la cual reclama una indemnización de 100 millones de pesos. Para ello, Fernández tuvo que pagar más de 3 millones en concepto de tasa de justicia.
En total, Fernández pagó 3.104.245. De acuerdo a Enríquez, “dicha suma resulta absolutamente incompatible tanto con sus ingresos como presidente de la nación, que son 256.207 pesos mensuales, como con su patrimonio, que según su propia declaración asciende a la suma de 5.7 millones de pesos”.
También resultó llamativo que para abonar la tasa de Justicia Alberto Fernández haya recurrido a un cheque de la sucursal de Lomas de Zamora del banco HSBC, “cuyo titular se ignora, dado que el presidente posee una cuenta corriente en el banco Santander”.
“Las circunstancias que rodean al pago de esa enorme tasa de justicia, ameritan que este hecho deba ser investigado a la luz de lo dispuesto por el artículo 268 del Código Penal”, asegura Enríquez en su escrito.
Por ello, es que el denunciante exigió que se requiera a Fernández para que justifique la procedencia de los fondos con los que satisfizo el pago de la tasa de justicia, se libre un oficio al banco HSBC de Lomas de Zamora, para que informe quienes son los titulares de la cuenta a la que pertenece el cheque y se intime al primer mandatario a prestar declaración indagatoria.
Como se recordará, Alberto Fernández había presentado ante la Justicia una demanda por 100 millones de pesos contra Patricia Bullrich, después de que fracasaran las mediaciones ordenadas por las autoridades. La dirigente del Pro había deslizado la existencia de irregularidades en la negociación entre el gobierno nacional y el laboratorio Pfizer por la compra de vacunas contra el coronavirus.
