Crimen de Evelyn: prisión perpetua por travesticidio para Ramón Da Silva
El Tribunal, con Viviana Cukla como presidenta y Marcela Leiva y Ángel Dejesús Cardozo como vocales, dictó la pena máxima para el acusado solicitada por el fiscal Martín Rau.
En la sexta y definitoria jornada del primer juicio por travesticidio en Misiones y segundo del país, después del Caso Sacayán en capital federal, el Tribunal compuesto por Viviana Cukla como presidenta y Marcela Leiva y Ángel Dejesús Cardozo como vocales, dictó prisión perpetua para Ramón Da Silva (33) acusado de asesinar a golpes a Evelyn Rojas en una estación de servicio abandonada en Posadas, durante la madrugada del jueves 27 de octubre de 2016.
Si bien los tres magistrados votaron por la perpetua, Leiva y Cardozo votaron por el triple agravante, vínculo, odio de género y condición de mujer; mientras que Cukla votó por homicidio calificado agravado por el vínculo y condición de mujer.
Durante la mañana se escucharon los alegatos, primero del fiscal Martín Rau, quien había pedido la pena máxima para Da Silva por el delito de homicidio calificado, agravado por el vínculo, alevosía, odio de género y condición de mujer, artículo 80, incisos 1, 2, 4 y 11 del del Código Penal Argentino.
Y luego de la Defensa que había solicitado la absolución por inimputabilidad. El abogado Mario Ramírez había solicitado que el imputado saliera de la sala de debate antes de presentar su alegato en el cual manifestó que su defendido cometió el homicidio pero no comprende sus actos, simplemente no siente empatía por terceros. De ahí el pedido de absolución. Sin embargo, la estrategia no dio resultados.
EVELEYN ROJAS. Tenía 26 años cuando fue asesinada un jueves 27 de octubre de 2016 en Posadas, más precisamente en Uruguay y Buchardo.
El hecho
El cuerpo de Evelyn Rojas fue hallado inerte en una fosa de cambio de aceite de vehículos en la vieja estación de servicio “El Refugio” en el cruce de las avenidas Uruguay y Buchardo.
La autopsia suena fría pero trasluce su descripción un crimen de extrema violencia y ensañamiento. A Evelyn le detectaron un hematoma “gravísimo” que involucraba todo el cerebro. Perdió la simetría facial y tenía “ojos mapache” por el volumen de la inflamación.También presentaba fractura de la base del cráneo y zona maxilofacial, rastros y señales de arrastre post mortem, además de hematomas en los pechos y pelo arrancado casi en su totalidad. La pericia detectó también un hematoma subdural que tendría tres meses de antelación.
