Absolvieron a Higui en el juicio por matar a un hombre cuando se defendía de violación grupal
Eva «Higui» de Jesús fue absuelta esta tarde en el juicio que se le seguía por haber matado a un hombre al defenderse de una violación grupal ocurrida en 2016 en la localidad bonaerense de Bella Vista.
El veredicto lo dio a conocer el Tribunal Oral en lo Criminal 7 de San Martín, luego de que la Fiscalía solicitara 10 años de prisión por «homicidio simple» y la defensa la absolución de esta lesbiana de 47 años.
Después de más de tres horas de audiencia durante la cual desfilaron cuatro testigos y prestó declaración la propia Higui, los jueces Gustavo Varvello, Germán Saint Martin y Julián Descalzo decidieron adelantar los alegatos y el veredicto, previstos inicialmente para el martes.
En consecuencia, las y los manifestantes que desde hace tres días mantienen cortada la avenida Balbín al 1700 frente a los Tribunales para reclamar la absolución de esta cartonera y futbolista fortalecieron su presencia en el lugar para que se escuchara más fuerte el grito de «Yo también me defendería como Higui».
Luego de conocerse el fallo y al hablar ante las y los integrantes de las organizaciones presentes, «Higui» les dio las «gracias por la protección y el respeto que ustedes solamente tuvieron».
«Gracias y vamos a seguir peleando por eso, por la defensa (legítima) guachas y guaches! ¡Vamos a sacar pibas, chicas trans de la cárcel! ¡Vamos chiques con todo que los necesito! ¿Dónde está Tehuel?», dijo De Jesús, en referencia a otras mujeres y mujeres trans presas por defenderse y al caso de Tehuel De la Torre, el joven trans de 22 años que desapareció cuando salió de su casa rumbo a una entrevista de trabajo en la localidad de Alejandro Korn.
Uno de los lemas de la convocatoria frente a los tribunales era «Autodefensa es salud» y «Yo también me defendería como Higui», en referencia a la aplicación de la figura de la legítima defensa en los casos de mujeres que se defienden contra hombres que las agreden con el resultado de que ellos mueren o tienen lesiones graves que ellas no quisieron ocasionar.
La última audiencia
Antes de los alegatos, en la tercera jornada del juicio, había declarado una mujer policía que asistió a Higui en el lugar de los hechos y en la comisaría, tres peritos –dos oficiales y uno de parte- y la propia acusada, que pidió hacer uso de su derecho para proclamar su inocencia.
«Quería declarar, tenía muchas ganas de hacerlo. Me siento mejor», dijo a la agencia de la asociación civil Presentes tras haber hablado al tribunal por poco menos de una hora, para reiterar su versión de los hechos de una manera «muy clara», según testigos de la sala.
La última declaración testimonial del día fue la que ofreció el perito psiquiatra Enrique Stola, conocido por su militancia antipatriarcal y por haber sido el psiquiatra de los dos jóvenes que llevaron a juicio por abuso y lograron la condena del cura Julio César Grassi.
«Hice una fundamentación sobre el estrés post traumático, en tanto peritos oficiales como de parte coincidieron en la existencia de estrés post traumático en Higui», dijo Stola en diálogo con Télam desde España, tras participar del juicio por videollamada.
«Creo que la Fiscalía quería demostrar que esto era producto de diferentes eventos traumáticos que tuvo Higui a lo largo de su vida y no por este ataque en particular, pero lo que yo señalé es que si bien es cierto que todos han producido estrés post traumático, la sintomatología al momento de la evaluación tenía que ver con el último porque los flashbacks, las escenas que se le aparecían, las angustias, pesadillas todo estaba relacionado con el momento del ataque», agregó.
Stola, quien participó durante la instrucción de la causa como perito de parte cuando la defensa de Higui era ejercida por Raquel Hermida Leyenda, explicó que «para que se constituya un estrés post traumático, la persona tiene que sentir que está frente a la posibilidad de muerte, ser agredida sexualmente o tener lesiones graves», y en el caso del ataque en cuestión se habrían dado dos de estos elementos, «aunque con una solo basta porque son situaciones que «producen tal conmoción emocional, psicológica, afectiva que impacta en el cuerpo y el psiquismo produciendo ese estrés».
«Lo que hice fue fundamentar que el estrés se debe a la agresión recibida y que si ella hubiese querido solo vengarse y matar y lo hubiera hecho, seguramente tendría culpa, porque no es una psicópata, y se sentiría deprimida por haberlo hecho, pero no tendría estrés postraumático. Si lo tiene, es porque fue atacada», concluyó.
Por otro lado y según pudo reconstruir Télam por fuentes judiciales, antes una mujer policía había dado fe durante su declaración de la magnitud de los golpes que había recibido Higui durante el ataque.
Se trata de una agente que estuvo en el lugar de los hechos apenas sucedieron y también en la comisaría junto a Higui.
«Esa policía dijo que estaba muy golpeada y que iban a cada rato a la celda a verla para que no convulsionara o para chequear que no estuviera quebrada. Eso es muy importante porque convalida el relato de Higui», dijeron las fuentes.
Durante los días trascurridos de juicio, declararon siete amigos y familiares de Cristian Espósito (28) –el hombre fallecido-, incluyendo al otro atacante de Higui –de nombre Sandro- que también lo hizo como testigo.
«Según su relato, él estaba frente a Cristian y viene Higui detrás suyo y le da dos puñadas a Espósito –que estaba a un metro- pasando por encima de su hombro, porque sí, como de la nada. El tema es que Higui mide 1.50, Cristian medía 1.75 y Sandro 1.65 o 1.70, es como físicamente imposible lo que relata», contaron fuentes judiciales.
Por otro lado, la perito forense ofreció detalles de cómo se produjo la única puñalada que resultó mortal, que desmienten lo asegurado a la prensa por la familia de Espósito -el hombre fallecido-: la hoja ingresó de frente a la altura del corazón y no por la espalda, como el miércoles describió la madre de la víctima y que podría hacer sospechar de un ataque a traición.
A pedido de la defensa, testimoniaron la abogada Claudia Spatacco, su psicóloga Raquel Disenfeld, sus hermanas Taty y Mariana, una vecina y el perito psiquiatra de parte Stola.
Además de las partes, en la audiencia estuvieron también la directora de protección del Ministerio de Mujeres Géneros y Diversidad, Romina Chiesa; la veedora del Ministerio de Justicia de la Provincia de Buenos Aires, Indiana Guereño; la militante de la organización lésbica Las Safinas Viviana Figueroa; y psicóloga de Higui, Raquel Disenfeld.
El caso
Con dos años de retraso en relación a la primera fecha fijada para el juicio, Higui llegó a juicio acusada de «homicidio simple» por defenderse de una violación grupal correctiva el 16 de octubre de 2016 en Lomas de Mariló, un barrio vulnerable de Bella Vista donde había ido visitar a su hermana por el Día de la Madre.
Y a pesar de que ella denunció un intento de violación grupal y de que fue encontrada desvanecida en el lugar de los hechos, con traumatismos en diferentes partes del cuerpo, el pantalón y la ropa interior rotos; el hecho nunca se investigó como tal
Tras ocho meses presa, la Cámara de Apelaciones de San Martín le concedió la excarcelación extraordinaria gracias a una fuerte movilización para exigir su libertad.
