Qué pasa con la AFIP
Una de las preguntas que muchos se hicieron después de conocer el monto del premio es cuánto de ese dinero queda en las arcas de la Administración Federal de Ingresos Públicos ( AFIP).
La Ley 20.630, vigente hace 50 años, estableció el «gravamen de emergencia a los premios ganados en juegos de sorteo». ¿Qué significa esto? Que el impuesto se aplica a «los premios ganados en juegos de sorteo (loterías, rifas y similares), así como en concursos de apuestas de pronósticos deportivos distintos de las apuestas de carreras hípicas, organizados en el país por entidades oficiales o por entidades privadas con la autorización pertinente».
Así, el impuesto se aplica a premios que salen de la quiniela, la Lotería y las apuestas en los hipódromos, por ejemplo: «aquellos juegos donde de un conjunto de elementos dados (billetes, números, bonos, etc.), al azar o por suerte, a uno o algunos de ellos se les atribuyen premios previamente establecidos».
¿Aplica a Gran Hermano, entonces? Según la ley, «los premios de juegos que combinan el azar con elementos o circunstancias ajenas a éste, tales como la cultura, habilidad, destreza, pericia o fuerza de los participantes, sólo se considerarán alcanzados por la ley si la adjudicación de los mismos depende de un sorteo final«.
En el programa que terminó ayer no hubo sorteo final, ni tampoco fueron el azar o la suerte los que determinaron el triunfo de «El Primo». En cambio, fueron cinco meses de distintas pruebas y el desarrollo de habilidades para sobrevivir en la casa, además de la destreza para ganarse la confianza de los otros participantes y el cariño del público.
De esta manera, Marcos podrá disfrutar de los casi 20 millones de pesos en su nueva casa, junto a su moto y su cerveza, sin pagar impuestos por el dinero que ganó.
