La Justicia de San Isidro determinó que ya no necesitan más pruebas en la causa que investiga la muerte de Diego Maradona. Por eso, los investigadores cerraron oficialmente la causa y ahora preparan el pedido de elevación a juicio. Se estima que ese documento, podría estar listo en los primeros días de abril. Hay ocho imputados, entre ellos el médico Leopoldo Luque y la psiquiatra Agustina Cosachov.
“Por los hechos que conforman la plataforma fáctica que se les han señalado (a los imputados) como acusación a partir de la profusa prueba reunida en el legajo que hoy la componen 40 (cuarenta) cuerpos de evidencia y anexos con la amplitud de prueba que ha caracterizado a ésta acusación pública en su sustanciación, corresponde, en la fórmula del artículo 334 párrafo 2° del Código Procesal Penal., declarar el cierre de la etapa preparatoria”, dice el documento de dos páginas que fue enviado a todas las partes para que queden notificadas.

Todos están acusados de homicidio simple con dolo eventual, un delito que tiene una pena similar al homicidio simple, es decir de 8 a 25 años. Di Spagna fue el último en sumarse a la lista. Se trata del médico que fue a ver a Maradona a la deficitaria internación domiciliaria en, al menos, una oportunidad. Según la acusación ignoró, al igual que el resto, los claros signos de deterioro que evidenciaba el ex futbolista.
El escrito elaborado por los fiscales Patricio Ferrari, Cosme Iribarren y Laura Capra, coordinados por el fiscal general John Broyad, comienza con una mención al último hecho relevante que tuvo la causa: El inicio de un expediente por falso testimonio contra Mariano Israelit, amigo de Maradona que fue el último en declarar de manera testimonial.
Israelit se presentó en la Fiscalía General de San Isidro para declarar como testigo, a pedido del abogado Rodolfo Baque, defensor de la enfermera Gisella Madrid. La psiquiatra Agustina Cosachov es otra de las personas apuntadas
Cuando le pidieron que lo muestre, encontraron una serie de anotaciones como “es una asociación ilícita” o “Audios Vanesa Morla”. Israelit intentó explicar que era un “ayuda memoria” peor igualmente se inició la causa por falso testimonio. Un testigo no puede tener un papel donde se le indique qué tiene que decir.
En el final del escrito que elaboraron los fiscales para cerrar la investigación, se ordena, además, comenzar un nuevo expediente para determinar si “otras personas no individualizadas y/o ligadas a la investigación podrían haber influido, directa o indirectamente, por acción u omisión, en el deceso del señor Diego Armando Maradona ocurrido el pasado 25 de noviembre de 2020″.
Esta situación se explica en los tiempos procesales. Como quedaron algunas medidas de prueba solicitadas por las defensas y las querellas, los fiscales decidieron no extenderse más en los tiempos y terminar esta primera parte de la investigación. Y, en paralelo, abrir otra causa para investigar lo que las partes creen necesario. Esa causa, que podría conocerse mediáticamente como “Maradona 2″, ya tiene un número de asignado. Es la “14-08-002093-20/05″.
De esta manera, la justicia dio por terminada una investigación que llevó casi un año y medio y que incluye más de 7 mil fojas cargadas de pericias, testimoniales e historiales médicos del astro del fútbol. Se espera que el pedido formal al juez Orlando Diaz para que eleve la causa a juicio se realizará los primeros días de abril.
El juicio, por su parte, se espera que se desarrolle entre finales de 2023 y principios de 2024.
