Máximo Thomsen; Ciro Pertossi; Enzo Comelli; Matías Benicelli; Blas Cinalli; Ayrton Viollaz; Lucas Pertossi y Luciano Pertossi son los ocho imputados por «homicidio doblemente agravado por alevosía y por el concurso premeditado de dos o más personas», un delito que prevé la pena de cadena perpetua.
De los ocho, el que más comprometido está es Thomsen, quien fue señalado por los testigos -y además está filmado en distintos videos- como el principal agresor de Báez Sosa y como el que le dio la patada final en el piso. Asimismo, en el rostro de la víctima se encontró la huella de su zapatilla, a la que la médica describió como una «marca en zigzag», una prueba que lo incrimina aún más.
A raíz de esta situación, Thomsen es también quien más afectado está anímicamente. De acuerdo con lo informado por el periodista Mauro Szeta, recibe asistencia profesional a diario para poder transitar la presión por el juicio y su probable condena. «Tiene psicóloga todos los días», indicó.
Según se informó, mientras dura el proceso judicial los rugbiers son despertados a las 6 de la mañana, desayunan, se visten y son llevados a los tribunales de Dolores, donde se lleva a cabo el juicio que tendría sentencia a fin de mes. Una vez concluida la jornada vuelven al penal, donde se encuentran alojados de a dos en cuatro celdas aisladas, para evitar posibles agresiones de parte del resto de los presos.
