Esperan un peritaje clave para definir el destino de Pity Álvarez
La Justicia aguarda un nuevo informe médico y psiquiátrico del músico Cristian “Pity” Álvarez para definir si lo someterá a juicio por el homicidio de un vecino cometido en julio de 2018 en el barrio porteño de Villa Lugano. “Trimestralmente nos deben enviar informes médicos, el próximo llegará en febrero”, afirmó a Télam una fuente judicial con acceso a la causa.
Mientras tanto, el exlíder de Viejas Locas e Intoxicados permanece internado en un centro terapéutico de la localidad bonaerense de Castelar, adonde fue trasladado desde la sede del Programa Interministerial de Salud Mental Argentino (Prisma), del Complejo Penitenciario de Ezeiza, en el que estuvo detenido por el crimen de Cristian Maximiliano Díaz, de 36 años.
Según las fuentes, el debate oral continúa en suspenso desde que en febrero de 2021 la Justicia considerara que el músico no estaba en condiciones psíquicas de afrontar el proceso.
Debido a esa situación, en abril pasado, los integrantes del Tribunal Oral en lo Criminal y Correccional (TOC) 29, Gustavo Goerner, Juan María Ramos Padilla y María Cecilia Maiza, resolvieron, en línea con lo planteado por el fiscal Sandro Abraldes en su dictamen, hacer cesar la prisión preventiva de Álvarez, de 49 años, por considerar que “no resulta constitucionalmente válido mantener el encarcelamiento cautelar por un tiempo absolutamente indeterminado, dado que no es posible pronosticar, de momento, cuándo podrá encontrarse en condiciones psíquicas de afrontar el juicio oral”.

En tanto, semanas atrás se viralizó una fotografía del músico junto a un fanático en la que se lo ve un visible aumento de peso y el pelo muy diferente a como lo usaba, posando en la vía pública. Al respecto, un allegado al músico confirmó a Télam que Pity había ido a atenderse a un consultorio externo, ya que padece “varios problemas de salud”.
En noviembre de 2020, Álvarez había sido internado en un hospital de la localidad de Ezeiza para ser atendido por un pico de diabetes. “La diabetes es reciente provocada por la desidia y por la mala atención del Estado, sobre todo en ese penal”, se quejó en ese momento Cristina Congiú, madre del músico.
Congiú contó que en 2021 su hijo se contagió con coronavirus, por lo que estuvo internado en terapia intensiva del hospital Muñiz, del barrio de Parque Patricios. “Cristian la pasó muy mal por el tremendo abandono de persona que sufrió en el penal”, dijo la mujer, y agregó que “lo que pasa con su enfermedad lo adquirió ahí por el aislamiento y la falta de atención”.
El hecho por el que el cantante está acusado ocurrió cerca de la medianoche del 12 de julio de 2018 frente a la puerta de acceso a la Torre 12 B del barrio Samoré, en Dellepiane Sur y avenida Escalada, de Villa Lugano. Según la acusación, Álvarez salió de allí junto a su novia y de repente se acercó a ellos Díaz, un conocido del barrio con quien comenzó una conversación que derivó en una discusión.
Testigos afirmaron que Díaz empujó e intentó pegarle a Pity, momento en que este extrajo una pistola y le efectuó un primer tiro en la cara y luego lo remató con otros tres balazos.
