Funcionarios antivacunas de JxC piden amparo por el pase sanitario
Alegan que “el pase sanitario lesiona de manera arbitraria e ilegal, derechos constitucionales de las personas voluntariamente no vacunadas contra el COVID-19”.
El diputado provincial, Horacio Loreiro, y el concejal de Montecarlo, Lucas Vega, ambos del bloque de Juntos por el Cambio presentaron en el Juzgado Civil y Comercial 1 de Oberá un amparo contra la Provincia de Misiones, el Ministerio de Salud Pública y el Ministerio de Gobierno de la provincia por la medida del Pasaporte Sanitario, que a partir del 1 de enero es obligatorio en los comercios, eventos, y lugares turísticos de Misiones.
Según esgrimen los legisladores, “el pase sanitario lesiona de manera arbitraria e ilegal, derechos constitucionales de las personas voluntariamente no vacunadas contra el COVID-19” y pidieron amparo bajo el paraguas del artículo 19 de la Constitución Nacional que expresa que “ningún habitante de la Nación será obligado a hacer lo que no manda la ley, ni privado de lo que ella no prohíbe”.
A partir de eso, solicitaron al juez que dicte una medida cautelar que deje sin efecto dicha resolución en todo el ámbito provincial y que se la declare anticonstitucional. Vale recordar que vacunarse no es obligatorio en el país ni en Misiones, pero tener dos dosis es requisito para participar de algunas actividades.
Fundamentos
Para Loreiro, con el pase sanitario “el gobierno está tratando de restringir y que volvamos a dos años atrás, encerrados y esto no funciona de esta manera” y por ello, manifestó que desde el espacio que representa “estamos totalmente en contra del pase sanitario, que no es un pase sanitario, porque así como está es un pase de vacunas de Covid nada más, porque si hay alguien que tiene alguna enfermedad contagiosa, pasa igual”.
El diputado de Juntos por el Cambio entiende que el pase sanitario es una medida “totalmente discrecional” y eso lo fundamenta, en parte, en el hecho de cómo el gobierno nacional definió el sistema de vacunación contra el Covid-19. “Las vacunas que alentó el gobierno para que todo el mundo se tenga que poner tenían cuatro condiciones que eran ser igualitarias, ser equitativas, ser gratuitas y por último, ser voluntarios. O sea fue la condición que sea totalmente voluntario, y vemos que en este caso no sería así”, observó.
